www.talenteo.eu website is a marketplace for intermediation dedicated to IT services. This marketplace is a place for virtual exchanges and its objective is to bring together the offers and requests of customers and consultants as part of an intermediation.

This place concerns B2B only. It is solely restricted to professional and sector-based use: IT services.

The marketplace's objective: Placement of SAP^® experts looking for short, medium or long term functional or technical assignments by enabling their introductions to companies having one-off requirements for outsourced SAP^® experts.

Registration on talenteo - De-registration

Consultant registration is restricted to SAP^® consultants having the skills necessary to be described as such.

Any consultant who is registered as a "Member" on talenteo ensures us that all his personal and professional data given to us are exact and true. The data are given on his own responsibility.

To be a member of talenteo, the consultant will have to fill in all the mandatory fields of his profile to validate his registration and thus become a Member.
The Member undertakes to inform talenteo of any modification concerning his situation (especially in case of a change in address). talenteo cannot be held responsible for any consequences that the Member and/or the third parties could suffer in the event that the Member would have failed to notify of any modification.
Any Member who becomes a member of the talenteo site has a right to modify, correct and delete data relating to him ("Data Processing, Files and Freedom" law n°78-17 of January 6, 1978). The Member can at any time object to the distribution of his personal data free of cost and without justification. To exercise this right, the Member must contact contact@talenteo.eu by email.
This personal data processing has been declared with CNIL under the number __________.
Any Member who registers on talenteo has the option to deregister, at any time, by specifying that he no longer wishes to be a talenteo Member. To exercise this right, he must send an email in this regard to contact@talenteo.eu.
According to Law n° 2000-719 of August 1, 2000, the contact details declared by the Member can be shared on request with legal authorities.
From the time a Member registers on talenteo, he has a User ID and password which cannot be shared with third parties. The use of the account is strictly personal and confidential. If a Member does not comply with the general terms and conditions of membership and use of the talenteo site, talenteo reserves the right to cancel his account without prior notice and without compensation.
The User ID is defined as the consultant code identifying a Member in a unique manner.
The password is defined as the confidential code chosen by the Member which, in combination with the User ID, enables his authentication to the service.
For the validation of his registration to the talenteo site, the talenteo Member must declare that he is aware of the existence of the general terms and conditions and that he accepts them. Accepting the present terms and conditions implies the adherence, complete and without reservation, of the Member to the present general terms and conditions. The acceptance of the general terms and conditions authorizes the Member to use all the talenteo services.

Any talenteo Member can have only one active registration on talenteo.

By registering, the Member acknowledges his awareness that he must be more than 18 years old and must have complete legal capacity.

Using talenteo

talenteo is not responsible for fraudulent use of the User ID and Password but can cancel without prior notice and without compensation the account in case the User ID and Password is usurped by a third party or by this Member.

The data provided by the Member are exclusively meant for the companies who search profiles for their SAP^® projects.

Any Member who uses talenteo must have a computer and the skills to use Internet and ensure the security, availability and integrity of all the data provided on talenteo.

talenteo Intellectual Property

The various elements of the talenteo site are protected by the regulations on industrial and intellectual property rights within the maximum limit of the law. These elements and patentable works are the exclusive property of talenteo.

Using, manipulating, changing and reproducing, even partially, the names, logos, animations, videos, texts and more generally any element or work open to protection by the regulations on Intellectual and Industrial property rights of the talenteo site is forbidden without the authorization of talenteo and will be liable to legal proceedings.

talenteo is not an entity or subsidiary of SAP AG. All data, texts, images and other patentable elements belong to talenteo.

Data confidentiality

The data registered on the talenteo site are exclusively used to help in the online placement of experts and to inform Members about new SAP assignments. The site data are confidential and cannot be sold to third parties, individual or legal entities, companies or organizations for a purpose other than the recruitment and selection of consultants. The data on the talenteo site Members are only meant for CV consultation, selection of experts and SAP^® assignments repository. Experts and companies use the talenteo service for the sole purpose of being introduced.

Warranty and responsibility

talenteo undertakes, as part of an obligation of means, to take every care and diligence necessary to operate a high quality service in compliance with the usages of the profession and state-of-the-art.

talenteo is not responsible for the contents and data given and registered on the talenteo site by the Members, especially as far as veracity and completeness are concerned. The Member discharges talenteo from any liability in case of claim for damages coming from third parties and relating to these contents and data.
IN ADDITION, THE MEMBER ACKNOWLEDGES THAT THE SOFTWARE USED ON THE MARKETPLACE COME UNDER A PARTICULARLY COMPLEX DOMAIN AS REGARDS DATA PROCESSING TECHNOLOGY AND THAT THEY CANNOT BE MATERIALLY TESTED OR EXPERIMENTED COVERING ALL THE POSSIBLE USES. THE MEMBER HENCE ACCEPTS TO BEAR THE RISKS OF IMPERFECTION OR NON-AVAILABILITY OF THE MARKETPLACE OR INTERNET SERVICE, WITHIN REASONABLE LIMITS. OWING TO INTERNET FEATURES, WHICH THE MEMBER DECLARES THAT HE PERFECTLY UNDERSTANDS, talenteo CANNOT BE HELD RESPONSIBLE FOR, IN PARTICULAR:
- THE CONTENT FROM DATA SENT, DISTRIBUTED OR COLLECTED, THEIR MANIPULATION AND THEIR UPDATE, AS WELL AS ALL FILES, ESPECIALLY THE ADDRESS FILES AND SOUND, TEXT, IMAGES, FORM ELEMENTS, DATA ACCESSIBLE ON THE SITE, FOR WHATEVER PURPOSE.
- FOR PROBLEMS OF ACCESSING THE MARKETPLACE DUE TO TOTAL OR PARTIAL NON COMPLIANCE OF A MEMBER OBLIGATION, DUE TO A FAILURE AND/OR A SATURATION AT CERTAIN PERIODS OF THE TRANSPORT NETWORK OPERATORS TOWARDS THE INTERNET NETWORK AND IN PARTICULAR DUE TO HIS ACCESS PROVIDERS.
- FOR MEMBER DATA AND/OR SOFTWARE CORRUPTION BY VIRUS, FOR WHICH IT IS THE MEMBER'S RESPONSIBILITY TO PROTECT.
- TO MALICIOUS INTRUSIONS OF THIRD PARTIES ON THE MARKETPLACE, IN SPITE OF REASONABLE SECURITY MEASURES IMPLEMENTED BY talenteo.
- FOR MALICIOUS OR ABNORMAL USES OF THE SERVICE.
- FOR INDIRECT DAMAGES, I.E., EVERYTHING WHICH DOES NOT RESULT DIRECTLY AND EXCLUSIVELY FROM PARTIAL OR TOTAL FAILURE OF THE SERVICE PROVIDED BY talenteo. ANY ACTION DIRECTED AGAINST THE MEMBER BY A THIRD PARTY CONSTITUTES AN INDIRECT PREJUDICE AND CONSEQUENTLY DOES NOT GIVE RIGHT TO COMPENSATION.
talenteo CANNOT BE HELD RESPONSIBLE FOR THE WRONGFUL USE OF THE MARKETPLACE BY THE MEMBER, FOR DISORDERS AND LOSS OF DATA THAT HE COULD GENERATE OR FOR HIS VIOLATIONS OF THE RULES OF USE.
NOTWITHSTANDING THE EXPLICIT PROVISIONS OF THE PRESENT GENERAL TERMS AND CONDITIONS, THE MEMBER IS SOLELY RESPONSIBLE FOR DIRECT OR INDIRECT DAMAGES, TANGIBLE OR INTANGIBLE, CAUSED BY HIMSELF TO talenteo DUE TO HIS USE OF THE MARKETPLACE AND UNDERTAKES TO INDEMNIFY talenteo AGAINST ANY DEMAND, CLAIM OR SENTENCE TO DAMAGES, OF WHICH talenteo COULD BE THREATENED, AND WHICH COULD BE PRONOUNCED AGAINST talenteo, SINCE THEY COULD BE CAUSED BY THE MEMBER'S USE OF THE MARKETPLACE.
talenteo does not guarantee the correct functioning, maintenance and repair of its site. The talenteo site can be stopped at any time for reasons outside talenteo. talenteo is in no case liable to pay material damages.

In addition, talenteo reserves the option to suspend access to its services due to maintenance or update. talenteo will inform the Members about planned or ongoing maintenance or update operations, on its website and as far as possible, and without being obliged to any guarantee or penalty and/or damages of any sort towards Members, it being understood that the time taken for these operations must remain reasonable.

Netiquette

The Member declares that he accepts the specific features and limitations of Internet and in particular acknowledges:
- That the Internet user community has developed a code of good conduct (NETIQUETTE) which the Member claims to understand well and the violation of which can result in the exclusion of the Member, without talenteo being held responsible for it;
- That the data circulating on Internet must not infringe the national and international laws, rules, uses or ethics in force;
- That the Member, by his behavior and by the data that he distributes, will act in such a way as not to affect the rights of third parties. - That the data and information circulating on the Internet network are likely to be diverted and captured. Consequently, the Member communicates confidential data (bank card code, etc.) at his own risk.
If a Member does not follow these principles and obligations, especially if he makes an abusive use of the Marketplace, talenteo reserves the right, subject to the provisions of the "cancellation" clause, to suspend, or cancel his registration without the Member being able to claim any compensation.

Use of tallying software

talenteo website uses an audience measurement and analysis software. talenteo chose to use a system in order to improve the quality and transparency of its service. All data collected during a Member's registration are used only to improve our website traffic.

Use of Cookies

talenteo uses "cookies" which contain data necessary to correctly manage the Member connection. It is therefore necessary that he accepts them on his browser; he has to ensure beforehand that his browser can handle them and that it is configured to accept them.
The use of cookies enables talenteo to understand its Members better. The cookies are in no case used to inform us about personal characteristics of the Members. Cookies are only used to inform the talenteo team on its site traffic. Cookies inform on the duration, date and time of the talenteo user connection.

Modification of the General Terms and Conditions

talenteo reserves the right to modify the general terms and conditions of use and sale at any time. The Member must stay informed about the modifications of the general terms and conditions of use and sale on the website. Any person who objects to the general terms and conditions of sale can deregister from talenteo as indicated in the "Registration" clause.

Introductions

Any talenteo Member can decide to be introduced to another talenteo Member.

Any person who is introduced to a talenteo Member must be registered on talenteo beforehand.

For any introduction, the Member must complete his CV in its entirety else the introduction will be refused.

An introduction is made between SAP^® Members who know each other or who have worked together on a SAP^® project.

Any talenteo Member who wishes to be introduced to another Member must give us his/her email address.

Recommendations

Any talenteo Member who decides to make a recommendation to another talenteo Member can only make a single recommendation per talenteo Member.

Any talenteo Member who is recommended by text receives an email with his recommendation to be approved. The text recommendations not approved by the talenteo Members will not be considered.

Management of Membership Cards

"Membership" cards enable the classification of Members, according to the number of positive actions that they perform in order to help in talenteo's growth (introductions, referrals, recommendations...).

General terms and conditions of the loyalty program

Any Member can participate in the loyalty program unless he refuses to do so. In this specific case, loyalty points will be accumulated by the Member but he will not be under any obligation to convert them to gift points.

The loyalty program started the day talenteo site was launched. Every Member must respect the correct functioning of the loyalty points program and the gifts distribution organization.

Gifts delivery

talenteo delivers gifts to the Member as soon as he converts his acquired points to gift convertible points. talenteo delivers most of the packages by postal service. The time for delivering gifts can vary from 1 day to two months depending on the stock of products.

Outside French territory, talenteo applies the general tax code as regards the application of VAT on the delivered products.

Outside France, only gift checks can be used.

Duration - pricing conditions

Except for the cases of cancellation mentioned in the present general terms and conditions, registration is for an unspecified duration. Any Member who wishes to deregister will have to, however, give a week's advance notice notified by email.

Registration is free of cost.

Law

The general terms and conditions of use and sale of talenteo are subject to French law.

No waiver

Should talenteo at any given moment choose not to exercise one or more of the general terms and conditions and / or to take advantage of a violation by the other party of any of the obligations listed in the present general terms and conditions, this does not imply that talenteo renounces its right to impose these same conditions at a later date.





talenteo Loyalty Program

Starting March 1, 2007, talenteo has implemented a loyalty program for consultants holding a talenteo account. Please refer to the General Conditions of use and sale of talenteo.

Our talenteo loyalty program enables experts to earn loyalty points for the following talenteo loyalty activities:

- At the time of registration
- At the time of a talenteo assignment
- At the time of a referral
- At the time of providing information about assignments in a company

The loyalty points can be used at any time at our gift distribution center as soon as you have performed at least one talenteo assignment. However, talenteo reserves the right to change at any time the gift distribution center if it does not prove to be convincing.

Information on the Points

There are two types of points:

The acquired points are the points accumulated during the activities of referral, introduction, and registration without having performed an talenteo assignment.

Convertible points are the points that you have accumulated which can be converted to gift vouchers as soon as you have performed your first talenteo assignment.

Loyalty program membership

Our members have access to the loyalty program as soon as they register with talenteo.
Any talenteo member has access to the loyalty program.
Membership to the loyalty program cannot be refused; however the member can refuse to have access to his loyalty points.

Acquisition of loyalty points

Members collect their loyalty points when they perform talenteo loyalty activities. The loyalty points can be used only by the person who accumulated them and can be used only once in the form of gift vouchers.
Members can only use their loyalty points if they perform a talenteo assignment. In this case, the acquired points can be converted to gift vouchers.
The talenteo site is free to decide when to award new loyalty points to its members.
Members are informed about the number of points accumulated when they log on to their talenteo personal account and click on "My loyalty points". The last statement of loyalty points enables members to convert their loyalty points into gifts.
The loyalty points are valid during the entire membership period of the member to the talenteo club and up to the end of the site's life span. Members will be informed by email one month before the validity of their points expires by their talenteo private club.
Any member who does not comply with the talenteo conditions of use and sale will have penalty points awarded, which will be deducted from his talenteo loyalty points.

Conversion of loyalty points to gift vouchers.

Members can convert their gift points when they so desire immediately after performing an talenteo assignment. The acquired points then become convertible points and they can convert them into gift vouchers.
Members must contact talenteo whenever they wish to convert loyalty points into gifts. Members must fill out his "gift purchase order" and fill out the address corresponding to the address where they want the gift to be delivered.
Members who do not comply with the general conditions of the talenteo Club cannot convert their loyalty points into gifts. talenteo is free to decide about this last condition.
Any attempted fraud with the loyalty points on the part of a talenteo member can result in the cancellation of his talenteo account.

Exchange into gifts

The general conditions relating to the loyalty points, the gifts" list and the gifts distribution organization will be managed by the talenteo team.
To view his gift points, a member has to log on to his personal account, and by going to "My loyalty points" he will have direct access to the list of gifts proposed by talenteo.
The loyalty points cannot be exchanged with another member or even be sold. They can only be converted into gift points by the center authorized by talenteo or by talenteo.

talenteo Contact

All the information relating to the loyalty points, the gifts list that can be viewed by our members and the name of the gifts distribution center are present on the talenteo site.

talenteo cancellation

Any Member who wishes to unsubscribe from the loyalty program will give up his registration to the talenteo site. In this case the member will have to convert his loyalty points into gifts before the cancellation of his talenteo personal account.
Any person who cancels his registration to the talenteo site will lose all his talenteo benefits.
Any member who uses the talenteo site fraudulently or for the interest of a third party will be unregistered from talenteo. Any person who uses the talenteo data illegally will be removed automatically from our database and will be not able to benefit from his loyalty points or even receive a compensation or indemnity.
In the case of a member's death, the person's account will be automatically cancelled without any possibility of compensation or indemnity for the spouse.

Modification of the talenteo conditions

talenteo reserves the right to modify at any time the general conditions of the loyalty program (statement of loyalty points, gifts list, gifts distribution center, general information).
talenteo reserves the right to modify or cancel the loyalty program subject to informing the talenteo members about this by email or regular mail while respecting a one month advance notice.
In the event talenteo cancels its loyalty program, its members will have a month to access the gift benefits. Once this period is over, the members will no longer have access to their loyalty points nor will they receive any compensation or indemnity from talenteo.

talenteo Service

talenteo aims to provide quality service to its customers. However, if the gifts distribution center does not have enough stock to satisfy the member, talenteo must keep him informed as soon as possible.
talenteo is not responsible for the good or wrong use of the gifts by the member.

Data Processing and Individual Freedom

The talenteo site member has a right to access, cancel or appeal to talenteo.

Law

The general conditions of this loyalty program are applicable under French law.

Acceptance of the general conditions

Any person who becomes an talenteo member must accept entirely and without reservation all the general conditions of the loyalty program.
